Introduction

This privacy policy is to provide information to you, our patient, on how your personal information (which includes your health information) is collected and used within our practice, and the circumstances in which we may share it with third parties.

Why and when your consent is necessary

When you register as a patient of our practice, you provide consent for our GPs and practice staff to access and use your personal information so they can provide you with the best possible healthcare. Only staff who need to see your personal information will have access to it. If we need to use your information for anything else, we will seek additional consent from you to do this.

Why do we collect, use, hold and share your personal information?

Our practice will need to collect your personal information to provide healthcare services to you. Our main purpose for collecting, using, holding and sharing your personal information is to manage your health. We also use it for directly related business activities, such as financial claims and payments, practice audits and accreditation, and business processes (eg staff training).

What personal information do we collect?

The information we will collect about you includes your:

  1. names, date of birth, addresses, contact details
  2. medical information including medical history, medications, allergies, adverse events, immunisations, social history, family history and risk factors
  3. Medicare number (where available) for identification and claiming purposes
  4. healthcare identifiers
  5. health fund details.

Dealing with us anonymously

You have the right to deal with us anonymously or under a pseudonym unless it is impracticable for us to do so or unless we are required or authorised by law to only deal with identified individuals.

How do we collect your personal information?

Our practice may collect your personal information in several different ways.

  1. When you make your first appointment our practice staff will collect your personal and demographic information via your registration.
  2. During the course of providing medical services, we may collect further personal information. Information can also be collected through electronic transfer of prescriptions (eTP) and My Health Record.
  3. We may also collect your personal information when you visit our website, send us an email or SMS, telephone us, make an online appointment or communicate with us using social media.
  4. In some circumstances personal information may also be collected from other sources. Often this is because it is not practical or reasonable to collect it from you directly. This may include information from:
    1. your guardian or responsible person
    2. other involved healthcare providers, such as specialists, allied health professionals, hospitals, community health services and pathology and diagnostic imaging services
    3. your health fund, Medicare, or the Department of Veterans’ Affairs (as necessary).
    4. In emergency situations we may also need to collect information from your relatives or friends.

When, why and with whom do we share your personal information?

We sometimes share your personal information:

  1. with third parties who work with our practice for business purposes, such as accreditation agencies or information technology providers – these third parties are required to comply with APPs and this policy
  2. with other healthcare providers
  3. when it is required or authorised by law (eg court subpoenas)
  4. when it is necessary to lessen or prevent a serious threat to a patient’s life, health or safety or public health or safety, or it is impractical to obtain the patient’s consent
  5. to assist in locating a missing person
  6. to establish, exercise or defend an equitable claim
  7. for the purpose of confidential dispute resolution process
  8. when there is a statutory requirement to share certain personal information (eg some diseases require mandatory notification)
  9. during the course of providing medical services, through eTP and My Health Record.
  10. Only people who need to access your information will be able to do so. Other than in the course of providing medical services or as otherwise described in this policy, our practice will not share personal information with any third party without your consent.

We will not share your personal information with anyone outside Australia (unless under exceptional circumstances that are permitted by law) without your consent.

Our practice will not use your personal information for marketing any of our goods or services directly to you without your express consent. If you do consent, you may opt out of direct marketing at any time by notifying our practice in writing.

Our practice may use your personal information to improve the quality of the services we offer to our patients through research and analysis of our patient data.

We may provide de-identified data to other organisations to improve population health outcomes. The information is secure, patients cannot be identified and the information is stored within Australia. You can let our reception staff know if you do not want your information included.

How do we store and protect your personal information?

Your personal information may be stored at our practice in various forms including electronic records, paper records and visual records such as x-rays, CT scans and photographs.

Our practice stores all personal information securely via electronic format and password protected information systems. Both clinical and administrative staff will only collect and access your personal information that is relevant to their role in your healthcare. All staff members sign a comprehensive confidentiality agreement. Administrative staff will access your health information only if required, for example: To answer a query you may have for example: the date of a referral, a request for a prescription renewal, the duration of a consultation or the results of investigations if you have elected not to return to receive them personally. To answer a query from an appropriate third party, for example, a relevant specialist requesting investigation results or a hospital requesting a list of current medication. To ensure optimal administration of your health information, for example, the scanning of relevant documents into your file. By giving consent to collect and access your personal information to MINT Clinic Pty Ltd, you also agree that such information will be available to administration staff, managers, medical and allied health practitioners employed by MINT Clinic Pty Ltd This enables us to care for you as a comprehensive multi-disciplinary team.

How can you access and correct your personal information at our practice?

You have the right to request access to, and correction of, your personal information.

Our practice acknowledges patients may request access to their medical records. We require you to put this request in writing [specify how your practice will receive such requests] and our practice will respond within 30 days.

Our practice will take reasonable steps to correct your personal information where the information is not accurate or up to date. From time to time, we will ask you to verify that your personal information held by our practice is correct and current. You may also request that we correct or update your information, and you should make such requests in writing to reception@mintclinic.com.au.

How can you lodge a privacy-related complaint, and how will the complaint be handled at our practice?

We take complaints and concerns regarding privacy seriously. You should express any privacy concerns you may have in writing. We will then attempt to resolve it in accordance with our resolution procedure. Please address all concerns to Kellie Greene via admin@mintclinic.com.au. Please include your mailing address and contact number. Your complaint will be processed and responded to within 30 days.

MINT Clinic complies with the Privacy and Data Protection Act 2014 (VIC) and the Health Records Act 2001 (VIC). Part of their privacy policy they are committed to protecting the privacy of individuals and their personal information. MINT Clinic uses, stores and disposal of personal information; the release of relevant personal information to other health professionals to allow quality medical care; inclusion in a recall register to be advised of follow up visits: inclusion in national/state reminder systems/registers (where applicable), medical updates and health information and the release of relevant personal information to (prospective) employers, their authorised representative and their insurer in the case of a work-related consultation or service (upon production of a signed consent authority). Clients may withdraw their consent for MINT Clinic to use and disclose personal information (except where we are otherwise required or authorised by law).

Website comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select "Remember Me", your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Where your data is sent

Visitor comments may be checked through an automated spam detection service.
